New Jersey call recording laws for AI data licensing

Short answer

New Jersey is generally treated as one-party consent. Recordings are only included in a license if they were lawfully made and callers were told how they may be used.

What this means#

  • One participant's consent is generally enough to record
  • If the other caller is in an all-party state, the stricter rule may apply
  • A recording notice at the start of calls is still best practice

Before licensing recordings#

  • Confirm notice was given on the recorded calls
  • Check whether your notice covered training and partner use
  • Remove names and personal details from transcripts
  • Voiceprints and biometric data are usually excluded
